By using our infrastructure and website, you agree to do so only for purposes permitted by law and our agreements. As a hosting and web services provider, we enforce a zero-tolerance policy towards abuse. You are strictly prohibited from:

Conducting systematic or automated data collection activities (scraping, data extraction) on our platforms without authorization.
Using our outgoing mail servers to send unsolicited emails (SPAM) or violating Canada’s Anti-Spam Legislation (CASL).
Engaging in any activity that unreasonably overloads our servers or interferes with the performance and availability of our infrastructure for other clients.
3. User Accounts and Security
For certain services, you will need to open an account. You are solely responsible for maintaining the confidentiality of your credentials (passwords, SSH keys, FTP access/control panels). You agree not to share your access with any unauthorized person. You are responsible for all activities that occur under your account. You must notify us immediately of any security breach or unauthorized use of your access.
4. Availability, Modifications, and Termination
We strive to maintain high availability of our services. However, we may, at our sole discretion, temporarily modify, suspend, or interrupt access to the website or certain services for maintenance, security, or hardware/software update purposes. We reserve the right to immediately suspend or terminate your access to our services without notice if you violate these terms (particularly Section 2 on acceptable use), without you being entitled to any compensation.
5. Intellectual Property
Unless a specific development contract states otherwise, Service Web Amachamax retains all intellectual property rights to the source codes, scripts, database architectures, and designs created by us, as well as the content of this website. Any unauthorized reproduction, reverse engineering, resale, or distribution of our hardware or software resources is strictly prohibited. In the event you submit ideas or feedback to improve our services, you grant us the right to use them without compensation.

7. Disclaimer of Warranties

8. Limitation of Liability
To the maximum extent permitted by applicable law, Service Web Amachamax shall in no event be liable for any indirect, punitive, or incidental damages (including loss of profits, loss of business data, cyberattacks against your applications, or business interruption) resulting from the use of our services or our website. Except in cases of gross negligence or willful misconduct on our part, our maximum and cumulative liability to you for any damages arising out of our services or business relationship shall be strictly limited to the total amount you paid us for these services during the twelve (12) months preceding the event giving rise to the claim, or to $500 CAD if no amount has been paid.

You agree to indemnify and hold harmless Service Web Amachamax (and its employees) from any claims, lawsuits, damages, or expenses (including legal fees) brought by third parties arising out of your use of our hosting services, the applications you host thereon, or your violation of these terms.

Our site and infrastructure may interact with third-party services (e.g., payment gateways, domain registrars). We are not responsible for the availability, security, or privacy practices of these third parties.
11. Force Majeure
Neither party shall be held liable for any delay or failure to perform its obligations under these terms if such delay is caused by a force majeure event beyond its reasonable control (natural disasters, major national telecommunication network outages, acts of terrorism or large-scale cyberwarfare, strikes, etc.).
12. Affiliate Marketing and Advertising
We may participate in affiliate programs or recommend partner software solutions. These recommendations are made in compliance with Canadian and Quebec legal requirements regarding advertising, notably the Consumer Protection Act of Quebec and the guidelines of the Competition Bureau of Canada.
13. General Provisions
Modifications: We may update these terms from time to time. Your continued use of our services after publication constitutes your acceptance of the new terms.
No Waiver: Failure to strictly enforce any of these provisions shall not be construed as a waiver of our right to enforce them subsequently.

14. Applicable Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of the province of Quebec and the federal laws of Canada applicable therein. Any dispute or claim related to these terms, our website, or our services shall be submitted to the exclusive jurisdiction of the competent courts of the judicial district of Abitibi (Val-d'Or), province of Quebec.
15. Language
These terms and conditions were initially written in French. Although an English translation may be provided for your convenience, in the event of any discrepancy in interpretation or translation, the French version shall prevail.
